That’s it. I had to have it. If I had to go to 10 separate stores, line up at 4 Am on “Black Friday” or go online and bid far more than my pocketbook would allow, the hot toy of the season was going to be mine. I pictured my daughter’s face opening it up. It would be the picture-perfect occasion when at last she would tear open the toy she had begged for all season. A year has now passed. Now what was that toy? I truly can’t remember… And I’m sure she can’t either.

Now rewind to that same Christmas. I also made her a pillow with her own name on it. I do remember carefully choosing the fabrics. I remember feeling so “gitty” when I found just the right color choices that would coordinate with her bedroom so perfectly. Everything that made her room hers, I found! I remember the night I put her to bed and ran to my sewing room so excited to get started on my project. I would hope she’d love it as much as I loved production it for her. There are only two ways to get divorced – you either settle, or you go to court.

We all would like divorces to settle. It’s less costly, takes less time, and hopefully, retains some dignity for the family.

There are many ways to rule and we will talk about them, but let’s start at the beginning.

Grounds

In almost all states in this country, divorce is “no fault.” That means that either spouse can get a divorce even if the other spouse doesn’t want the divorce. It does not need to be proven that the other spouse was a bad man in order to get a divorce. The language is typically that the marriage is “irretrievably broken” with no occasion for reconciliation.

“Pro Se” Divorces

Most citizen who go straight through divorce have lawyers. But there is a trend in this country that citizen not retain lawyers. citizen who go straight through divorce without a lawyer are called “pro se.” The statistics are that at least 50% of the citizen who go straight through divorce or sue each other after the divorce have no lawyer.

Problems With “Pro Se” Divorces

1. Revenue taxes. Many citizen do not understand the tax consequences of transferring certain property, such as the house, or stock with a low basis. One of them may be stuck with a huge tax bill.

2. Missed assets. If the parties don’t thoroughly understand the divergence between marital and separate property, some property may be transferred without fully understanding the legal options.

3. Pensions. Sometimes, resignation accounts are the most primary marital asset. If the parties do not fully understand the resignation plans, they could grossly undervalue what is to be divided. Some also fail to understand the consequences of the death of the laborer or the nonemployee. In these cases, benefits could revert to the company rather than the beneficiaries the parties intended.

Waiting Periods

1. Residency

In all states, one spouse needs to have been a resident for a certain duration of time for the court to have jurisdiction to divorce the couple. The typical length of time is 90 days.

2. “Cooling off” period

The other time duration that states have is the “cooling off” period” intended to preclude citizen rushing straight through the divorce. In many states the duration of time from when you start the case to when you end the case is typically 90 days. Even though that duration is relatively short, the mean divorce case takes about a year. About 95% of divorce cases reach a settlement. If no community is reached, the parties go to trial and the judge makes the final decision.

Temporary Orders

The duration of time between the starting and the end of the case, is a time when the financial and emotional life of the house goes on. There are children to feed, there are mortgages to pay, there are insurances to deal with. This is the temporary period. There are two types of discovery: informal and formal.

1. Formal Discovery

Formal discovery includes legal procedures such as depositions, interrogatories, and requests for production of documents.

Informal discovery can be as straightforward as one lawyer calling the other lawyer and saying, “Send over to me all you’ve got about the Smith case along with financial affidavits, tax returns, check stubs, venture statements, list of assets, and anyone else we might need to see.” And the other lawyer responds, “Okay, you’ll have it by Friday.”

Well, it might not be quite that straightforward but if the spouse’s lawyer is cooperating, he/she adds to the informal discovery by voluntarily providing requested facts and documentation. The best lawyers do this without hesitation and give unblemished relevant financial facts. The lawyer knows he will be required to contribute this facts anyhow, and he can save time for the client and himself, as well as the charge of formal discovery.

Trials

If the parties don’t settle, then they go to trial and have a judge rule their future. Only about 5% of divorce cases actually go to trial. either they rule “on the court steps” or earlier is impossible to ascertain. That fact that about 95% of them rule is good because if they have come to an deal on their own, they are more likely to honor that deal than one handed down to them by “the man in the black robe.” In one sense, they have taken fee of their own time to come and it gives them a feeling that they are in control. Going to court takes all control away from them.

Approaches to Settlement

There are some ways to arrival settlement:

1. Husband wife rule on a settlement.

Throughout mediation, alternative solutions are offered, issues are clarified, and a community is arrived at. The mediator’s job is to be a facilitator and to help the consolidate work together. The mediator has no authority to force a decision upon them. If you and your spouse are communicating, then mediation should be explored. The goal of mediation is to get past the positions that citizen come in with and work toward what they actually need in order to be satisfied with an agreement.

Mediation doesn’t eliminate your need for a competent attorney. It does need voluntary participation of both husband and wife. A goal of the mediation process is to draft the figure of a settlement. The parties will then have a lawyer take the figure and prepare a formal divorce deal based on the terms of the mediation. If you are using only your spouse’s lawyer in your case, seek a second thought from your own lawyer. Have this lawyer clarify the pros and cons and importance of each provision. Remember, you will have to live with this the rest of your life.

4. Arbitration

Arbitration is other tool for avoiding a lengthy and expensive trial. An arbitrator acts as your own secret judge who conducts a “mini-trial” of sorts, in which the parties and their lawyers present their cases. Arbitration is used more in some areas than in others, and can be particularly moving if you live in an area with a huge backlog of cases. If you agree in advance to what is called binding arbitration, the arbitrator’s decisions are final and come to be a court order just as if you had gone before a judge. On the other hand, you can agree that the decision of the arbitrator is only “advisory,” in which case you would not be required to succeed his or her decision.

An arbitrator can be used for the entire process or only to rule certain issues. The arbitrator may even offer a blend approach, mediating initially, but manufacture a decision for you if you cannot agree

5. Collaborative Divorce

Sometimes it is (1) attorney, sometimes it is (2) attorneys and sometimes it involves the Judge. In this particular case, here is poor slight “Linda” getting a disjunction from “Outdoor Bob”. Prior to their marriage, Linda had perfect prestige and Outdoor Bob, being a rascal, had ziltch for credit. Linda was told by Mom and Dad, don’t marry that bum. Well, love prevailed and they got married.

Outdoor Bob, needed a truck to go to work. Linda went with Bob to the local Ford dealer and bought a new Ford pickup. Linda had the prestige so the loan was in her name. About six months later, Bob started to stop off on Friday at the local saloon to cash his paycheck. Sure enough, there was a dart board there and a few of the guys started tossing darts for beers. Bob was pretty good and they invited him to be on the local dart team.

This meant institution on Tuesday and Thursday night with tournaments on Fridays. Well, Linda got fed up with this malarkey and arguments started. Soon a disjunction was the only solution. Linda’s parents were the old fashioned ” I told you so” type of folks. They did not get into the middle of the squabble.

When they went to court, the lawyers agreed that Linda would get the kids and Bob needed the truck to get to work so he could pay Linda. Sounds logical, but dangerous. The Judge Never instructed whatever to find out “who was on the loan” but simply awarded the truck to Outdoor Bob. As long as he kept his carpenters job, he could make the payments. Everybody was satisfied.

Linda moved to Florida and got a job as a, school teacher, here in the area. She wanted to buy a house so that the kids could have a home. Lo and behold! She gets a consideration that Ford Motor prestige is suing her for the insufficiency equilibrium on the Ford truck that they repossessed from Outdoor Bob. The insufficiency was over ,500.00 Even though the Judge instructed Bob to make the payments, he didn’t. The judge never opinion to check with Ford Motor prestige to see if they would accept Outdoor Bob as the new guarantor on the loan. They of policy wouldn’t have done it anyway. After all, Bob’s prestige was terrible.

The end of the story is we were able to get the lawyer for Ford Motor prestige to accept a much lesser whole because he was trying to get a default judgment on his fees. That was illegal here in Florida, so with his hands in the cookie jar, he just wanted to get it over rather than have his name settled in front of the Florida Bar Assn.

That’s the point of knowing what to do in a disjunction situation. This could have been averted If the Judge had stipulated that Outdoor Bob would get the truck If he excellent under the prestige requirements of the lender.

Divorced folks authentically do not have any place to go for guidance. That’s just plain ridiculous. What we do with a gift is our responsibility. everything has the potential to be a blessing or a curse. God gives us free moral division to determine what we will for ourselves, what we will do with what we’ve been given: whether we’ll squander our legacy or use it wisely, with an attitude of gratitude and loving obedience.

These verses prophesy destruction of everything and everyone which does not jibe with what you’re telling me.

I did not ignore it and I did address it. Mankind will get to the point of no return: except for divine intervention no flesh would be saved alive, no human being would remain, just as Yeshua and the Prophets foretold. Within that Scripture it reveals survivors who are praising God, which I have highlighted.

God all the time saves a remnant to keep His promise alive to Abraham, Isaac and Jacob that He would be their God and the God of their descendants (which means they must all the time have some descendants). This Good News is why the first lesson of Beyond Babylon: Europe’s Rise and Fall is appropriately called, “Survival Guaranteed!”

Many times Thanksgiving is over looked as a time to do a schedule because Christmas seems so much more exciting. That is not so, a Thanksgiving schedule can be used to teach students the history of the starting of this country and can encourage the students to learn to be thankful for the things that are colse to them.

Thanksgiving time is a perfect time to put on a short program. These programs can teach a lot of history as they are put on. Use words that you want your students to remember and know such as: Mayflower, Plymouth Rock, Pilgrims, Indians, country, England, etc. It is a perfect time to let the students express what they are thankful for and use a prop showing that. Students love props and so this is one easy way to let them use a prop.

Thanksgiving

Thanksgiving programs should contain the history part of Thanksgiving, turkeys, families and then and now. A comparison of then and now would be great to combine into a program.

Of course, Thanksgiving is not Thanksgiving without telling what we are thankful or. This is a great way to contain other kinds of music other than Thanksgiving type of music. There could be two sections here. A section of things that everyone is thankful for such as: our country (put in a patriotic song), our bodies (put in an rehearsal song), school (put in a studying song), friends (put in a friendship song). This section of the schedule could give a lot of diversity to what you are doing while the program.

The second section of the schedule could be about things that individual students are thankful for. It could contain wee segments of things that the students are thankful for such as: A student could say I am thankful that I can dance and then let them do fifteen seconds of their popular dance, or I am thankful that I can tumble and have them do fifteen seconds of tumbling. This area could be real fun for students that have an imagination. Maybe they are thankful that they can tell a joke and they could tell a joke, etc.

I can see great possible for doing a power point presentation using the students’ art. Their names should be displayed and they could do a one line narration while the schedule of what they are thankful for.

To end the schedule find something that is base to the audience such as patriotism. Have the audience share in singing. Audience participation in songs literally helps get the audience into the schedule instead of just watching the schedule as an observer. That way they become part of the entertainment.

Maybe it is time to give Thanksgiving its proper place and maybe alternate each year with a Thanksgiving schedule and then a Christmas program. It might give everyone something to look at.

The word free seems to take on another meaning in the church. Nothing stands out more, to a person in need, than to see a church marquee with the word “Free”. If you want to draw a crowd and fill the pews, use this word on your marquee. Lets take a look at the word and its meanings:

Not controlled by enforcement or the will of another.
Not branch to external restraint.
Costing nothing; gratuitous: a free meal.
Unobstructed; clear: a free lane.
Given, made, or done of one’s own accord; voluntary or spontaneous.
Unconstrained; unconfined: free expansion.

Thanksgiving

The preceding list seems to accurately define the word free. We’ve become so careless with words, especially when it comes to getting quick results in the church. As I recall, the Gospel message is to all and for all whom would hear it and believe it; there is no enforcement to listen to it, no enforcement to riposte to it, only consequences for the rejection of it.

Often, the good intentions of the church, to reach the lost by any means, turns out to be a desperate exertion to build numbers and so exiguous to do with “teaching all nations. Where do we draw the line in the use of gimmicks? Since when do we implement gimmicks and attached conditions (calling it ministry) on what we do for others? For instance; I received a post card from the local church that read the following:

“Free Thanksgiving Hen & Grocery Sack of Food to fix your Thanksgiving Dinner”

This event requires those receiving this “Free Grocery Sack” to register for the event and “Plan to stay for a worship service”. You can miss things when you dint read the fine print. While the phrase “salvation is free” rings true, but it did cost Jesus His life. No organization, should attach a health on the society aid they provide, in the name of Jesus Christ. I’m sure when members of the Christian community, rushed to Haiti to aid the people, there were no conditions to receive the help.

The Gospel of Jesus Christ should be given freely to any and all who will listen (without a hook of gimmick) and believe on Him. If you happen to be feeding the hungry, then well done. The Gospel of Jesus Christ should come without cost to them who have nothing. Their should be no enforcement or constraint of any kind to the hearer, to receive this Life Changing message, in short No Strings Attached.

‘The kingdom of heaven is near.’ 8. Heal the sick, raise the dead, cleanse those who have leprosy, drive out demons. Freely you have received, freely give. (Matt 10:7)

I picked up this great book which has opened my eyes to probably the oldest new opinion for fat loss. The book is called Eat Stop Eat by Brad Pillon and in a nutshell it is about intermittent fasting.

Black Friday

So this weekend I am going to try my first 24 hour planned fast. Basically this means I will be going without food for 24 hours between supper last night and supper tonight. There is a lot of uncertainty with what I am doing plainly because I have never done this before.

As with my training ideas, you will know that uncomplicated doesn’t always, well rarely, means easy. I expect the same to come of this. So sit back, relax and lets see what happens!

6:45 pm Friday

I wanted to have supper as early as possible tonight so that I could eat sooner tomorrow. That didn’t happen though. I smashed straight through my supper and probably ate too much in anticipation of not eating for another 24 hours. Then I have my first ‘food’ thought. I am in the kitchen development a cup of tea and went to grab some food off the supper plate that hadn’t been finished. Whoops, I can’t eat that. But I don’t indubitably want to eat it, I am stuffed like a pig. But it is there and I felt like eating it. I didn’t eat it but all I can think about for now is food and the fact that I can’t be eating for the next 23 hours and 48 minutes!

After playing the Wii for a while it is time for bed, and I haven’t opinion of food or felt hungry again. Usually I would have something to eat before bed but not tonight, no big deal really.

8:07 am Saturday

I was lucky sufficient to get a sleep in this morning. Rach and Ash were up a bit earlier but I was catching Z’s. When I got up, I’m thinking of what I can’t have for breakfast, although I’m not indubitably hungry. So it’s just a black coffee and that’s fine. all seems normal, plentifulness of energy, no jitters or shakes or anything different to be honest.

10:23 am Saturday

About to head into town to see a friend in hospital. Just had the coffee and water today. Thoughts of food are far away, although I presume that will convert when we pass all of the food outlets and Rach and Ash have lunch.

1.14 pm Saturday

We have been somewhat busy this morning and the time has gone quite quickly. It isn’t until I look at the clock and realise how late it is (compared to what I would have Usually eaten by now). Rach and Ash are getting into some corn chips as we wait in the car at my mom’s house. I would have said I’m hungry but I wasn’t before the chips came out and I started salivating! So am I indubitably hungry or do I just want food? I’d recommend it’s the latter as I don’t care to eat anything else once I have had a green tea and black coffee.

I am beginning to think that supper time will come around fast now and the 24 hours will have passed without any bother. It’s strange because I Usually feel ‘hungry’ if I have a late breakfast.

4.19 pm Saturday

The girls are asleep and I have just had a quick 20 exiguous recharging nap. I would probably do this 3 times per week depending on how I feel. So it has nothing to do with my vigor levels because of the fasting. In fact I feel wholly general (well as general as I have ever felt!!)

I can’t believe there is only just over two hours to go. I must admit that I have been thinking about what I will be eating for supper tonight quite regularly, but that is fairly common for me.

6:02 pm Saturday

I’ve been working on the website and doing some research for my bootcamp launch and the time has passed me by. The girls are still asleep!! so I might get a start on dinner. Some meat and veges should do the trick.

7:01 pm Saturday

Well the 24 hours has been and gone and I am amazed at how uncomplicated (and easy) that was. I was a bit scared of the unknown last night because I hadn’t done anything like this before. Now i think it has to be the easiest weight loss solution going around. I feel as though I could go for longer as well. Now that I can eat there isn’t an extraordinary feeling that I need to stuff my face because I am hungry.

I don’t indubitably know what real hunger feels like anymore. I haven’t eaten in over 24 hours yet I don’t feel compelled to eat. Strange I know but very hard to explain.

Because my vigor levels were so good I want to try a 24 hour fast while the work week and throw in a training session as well. That will be a bigger test but after the ease of this phase I can’t see why that would be any more difficult.
